In requesting a restricted Certificate of Sponsorship, the following information should be available:
– The total number of applicants who applied for the role;
– The number who were shortlisted;
– The number of each who are resident workers in the UK; and
– The reasons none of those candidates were appointed.
Unless the reason for not hiring settled candidates relates to them not holding the necessary skills and experience for the role, there will be a difficulty in satisfying the requirements of the resident labour market test. There needs to be some evidence that this is the case.
